Terms of Service

    These Terms of Service ("Terms") govern the access and use of the Services provided by SigmaLabs AI ("Company", "we", "us") to you ("User"). By using the Services, you agree to these Terms.

    1. Definitions

    • Account: means the user profile for accessing the Services.
    • Brand: means your trademark and related visual identity provided for use with the Services.
    • Credits: means virtual credits for creating and downloading content.
    • Content: means all marketing materials (texts, images, emails, ads) generated through the Services.
    • Services: means the SigmaLabs AI platform for content creation.
    • Subscription: means your registration and payment acceptance for ongoing access to the Services.
    • Subscription Plan: means the subscription tier chosen by you (Starter, Professional, Scale).

    2. Access and Use

    You are granted a non-exclusive, non-transferable right to access the Services for internal business purposes.

    Restrictions: Copying, reproducing, reverse engineering, illegal use, uploading content that infringes third-party rights, unauthorized access, transmitting harmful content, or reselling the Services is strictly prohibited.

    Account Security: You are responsible for safeguarding your account credentials.

    3. Services

    Service Delivery: Services are deemed delivered upon the provision of access credentials.

    AI Content: Generated AI content may not be unique and similar results may be generated for other users.

    Account Management: You can cancel your account at any time by sending an email to support@sigmalabs.gr.

    4. Subscription and Payment

    Prices: Current prices are displayed on the website. Price modifications will occur with a 30-day notice.

    Billing Cycles: Monthly, Quarterly, or Annual. Automatic renewal unless cancelled.

    Cancellation: Email support@sigmalabs.gr. Takes effect at the end of the current cycle. No partial refunds are provided unless explicitly stated.

    Payment Methods: Major credit cards. Accurate billing information is required.

    Credits: Unused credits do not roll over to the next billing cycle.

    Refund Policy: We do not offer a free trial. We adhere to a strict no-refund policy, with the sole exception being if you do not receive the first analytics report within one week (7 days) of registration. Please note that the AI requires approximately 60 days to train fully on your e-shop data for optimal performance.

    5. Intellectual Property

    All Services, software, algorithms, and platform elements remain the exclusive property of the Company.

    You retain all rights to your Brand and imported materials. A license is granted solely to enable the provision of the Services.

    You own the Content generated for you, subject to non-exclusivity terms.

    6. Disclaimers

    The Services are provided 'AS IS' without warranties of any kind.

    There is no guarantee of uninterrupted or error-free operation.

    Limitation of Liability: Our total liability shall not exceed the amounts paid by you in the six months preceding any claim.

    7. Data Privacy

    Data is processed to provide the Services, in accordance with our Privacy Policy.

    Security measures have been implemented to safeguard your data.

    GDPR compliance is maintained where applicable.

    8. Termination

    By you: You may terminate the subscription in accordance with cancellation requirements.

    By us: We may suspend or terminate access for violation of terms, non-payment, illegal use, or infringement of third-party rights.

    9. Confidentiality

    Each party must maintain the confidentiality of the other's proprietary information and not disclose it to third parties.

    10. General Provisions

    • Entire Agreement: These Terms constitute the entire agreement.
    • Amendments: We may update the Terms with a 30-day notice. Continued use constitutes acceptance.
    • Governing Law: Laws of Greece
    • Severability: If any provision is invalid, the remainder remains in effect.
    • Assignment: Prohibited without prior written consent.
    • Force Majeure: Neither party is liable for delays beyond their reasonable control.
